Definitions:
AI Product means any SIS product that utilizes artificial intelligence within the product.
LLM Provider means Amazon Web Services.
Processing by Third Party LLM Providers. When using SIS AI Product, LLM Provider acts as a sub-processor of personal data submitted to SIS, including personal data that may be contained in Inputs (defined below) or other Customer Materials or Customer Data. All personal data processing activities will be governed by the DPA in place between SIS and Customer.
Location of Processing. If Customer decides to use SIS AI Product, Personal Data sent to LLM Provider will be processed in the following regions, based on Customer’s location:

Inputs and Outputs. Questions, data, content or information submitted to SIS AI Product by or on behalf of the Customer (“Inputs”) and answers or other results generated by SIS AI Product based on such Inputs (“Outputs”) shall be considered as Customer Materials, respectively. Inputs and Outputs therefore fall under this Agreement and are subject to the rights, restrictions and obligations applicable thereto including (but not limited to) the confidentiality provisions as set out in this Agreement.
Accuracy. Outputs may contain material inaccuracies and may not reflect correct, current or complete information. The Customer may not mislead others that Output is human-generated. The Customer may not rely, or encourage others to rely, on any Outputs without independently evaluating their accuracy and appropriateness of use, including the use of control through human intervention. SIS makes no representations or warranties and provides no indemnities with respect to Outputs.
Rights to Use. Customer permits LLM Provider to use Inputs and Outputs or other Customer Data/Personal Data/ Users' Personal Data submitted to SIS AI Product as necessary to provide and maintain the SIS AI Product, comply with Applicable Laws, and enforce its respective policies.
Restrictions on Use. In addition to any general obligations and restrictions pertaining to Customer’s use of Services under the Agreement, Customer represents and warrants that:
Customer’s use of SIS AI Product will not breach or violate the use restrictions as set out in the Agreement or any third party terms, policies or other agreements, nor will Customer use SIS AI Product to generate content for dissemination in electoral campaigns or content that encourages violence, terrorism, or other serious harm;
Customer will be responsible for determining whether its use of the SIS AI Product is effective, lawful and safe. The the SIS AI Product and/or any components thereof are not intended to be used for and Customer shall not use them for: prohibited practices under the European Union Regulation 2024/1689 (the “EU AI Act”) and/or for any use that would change them into high-risk AI systems or that otherwise qualifies as ‘high-risk’ as meant in the EU AI Act. Customer is responsible for any decisions, actions, and/or inactions arising from its use of the SIS AI Product, including ensuring compliance with applicable laws, regulations, and other legal requirements.
Customer will only provide and/or instruct to use content from publicly accessible website(s) or other sources where its use (including data extraction) is explicitly permitted and/or where Customer is authorised to do so; and
Customer will not, nor permit others, to: (i) use SIS AI Product to develop any models that compete with SIS AI Product or LLM Provider or (ii) use any method to extract data, or infer information, from SIS AI Product or otherwise attempt to discover underlying components of SIS AI Product (e.g., models, algorithms, systems) (except to the extent such restrictions are contrary to applicable law).
Customer will be fully responsible for use of SIS AI Product (including any and all Inputs submitted) by any User and any other person as if was effected by Customer itself.
